THE FOLLOWING TERMS GOVERN OUR AGREEMENT TO PROVIDE SERVICES TO YOU AS THE CUSTOMER. IT IS IMPORTANT THAT YOU READ THESE CAREFULLY AND IN FULL BEFORE ORDERING ANY SERVICES FROM BARRK TRAINING.

IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU WILL NOT BE ABLE TO ORDER ANY SERVICES FROM BARRK TRAINING.

BY NATURE OF PAYING FOR SERVICES FROM BARRK TRAINING YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS

General Terms and Conditions

These General Terms & Conditions together with any Service Agreement for your Services form the Agreement between You and Us. If any of these General Terms & Conditions are inconsistent with any Service Agreement terms for your Services, then the Service Agreement shall prevail.

By completing payment the Services you warrant that you are capable of entering into a binding contract; or are acting with the express permission of a person or organisation and using the payment details of that person and that they also agree to be bound by the terms of this Agreement. You also agree to comply and adhere to any and all applicable laws and regulations in relation to this Agreement.

Barrk Training reserves the right to amend, modify or alter any of these Terms and Conditions without the prior consent of You.

  1. General Policies

    1. Registration & Dog Information

      1. It is the Customer’s responsibility to provide clear and accurate information to Barrk Training on the Registration Form and any other documents that are provided to the Customer for completion. Changes or updates to the Registration Form must be put in writing to Barrk Training. Email updates are acceptable. Barrk Training shall be held harmless from claims where outdated written information is responsible for the incident, unless Barrk Training can be shown to be negligent.

      2. It shall be the sole responsibility of the Customer to inform Barrk Training of their dog’s ongoing medical conditions or significant illnesses and conditions that they have suffered in the past. Barrk Training shall not be held liable for decisions that are made, or their subsequent outcomes based on an omission of information of their dog’s registration form.

      3. The Customer shall make clear on the Registration Form (or during consultation) any disputes related to the ownership of the dog, and legal matters relating to the dog for example a court order.

      4. The Customer confirms that the dog is not subject to a Control Order under the Dangerous Dog Act 1991.

    2. Vaccinations, Parasite, & Disease Control

      1. It is preferred that dogs participating in Group Classes are vaccinated in accordance with veterinary recommendation, including the vaccination for Leptospirosis. Kennel Cough vaccination is also preferred but is not mandatory.

      2. There can be no guarantee that there is absolutely no risk of disease at any venue or when in contact with any other dogs or equipment which may have been in contact with other dogs. It is the Customer’s responsibility to ensure that their dog is appropriately protected against the risk of disease.

      3. It is preferred that dogs participating in Group Classes are treated for worms and fleas. If fleas or worms are found to be present during the Services, Barrk Training shall remove the dog from the session to prevent contact with other customers and their dogs.

      4. The Customer must contact Barrk Training prior to arriving for Services if the dog is suspected of having a contagious illness.

    3. Allergies & Food Intolerances

      1. If a dog has any known allergies or intolerances to certain foods or has any other special needs, it is the Owner's responsibility to bring this to the attention of the Trainer prior to the start of the session, and to provide appropriate alternative treats or rewards for the session.

    4. Under 18's Training Classes & Sessions

      1. Under 18's are very welcome to attend training sessions, with appropriate adult supervision. Barrk Training accepts no responsibility for children at training sessions and it is the responsibility of the supervising adult to always ensure the children’s safety.

    5. Training & Handling Methods

      1. The training techniques used by Barrk Training are based on the principles of positive reinforcement and, as such, are reward-based, kind and fair to the dog.

      2. The harsh handling of dogs, including the use of physical force, is not permitted during training sessions. Punishment or corrections by way of equipment designed to be aversive (such as, but not limited to, choke chains, prong collars, check chains, e-collars, spray collars) are not permitted in training sessions.

      3. Barrk Training agrees to bide by the IMDT Code of Ethics & the UK Dog Behaviour and Training Charter.

    6. Veterinary & Legal Advice

      1. Trainers working for Barrk Training are not qualified to provide veterinary or legal advice, and the information they provide is not intended to constitute such.

    7. Standards & Insurance

      1. Barrk Training agree to provide a professional and reliable service to their customers. All animals under the care of Barrk Training will be given the full care and attention needed to make their experience both fun and safe.

      2. Customers must accept that accidents or illness may occur in such a manner that can neither be foreseen nor prevented by Barrk Training. The Customer shall indemnify Barrk Training, who shall be held harmless in the following circumstances, unless the company can be shown to be negligent:

        • If a Customer's dog causes harm to a person, animal, or damages property.

        • If a Customer's dog is injured or causes an accident.

        • If a Customer's dog causes a third party to claim for damages by way of injury to a person or an animal, or damage to property. In such cases, the Customer will indemnify Barrk Training against such claims and will liaise directly with the claiming third party.

      3. Where negligence is proven by the Customer, claims shall be settled within the boundaries of the company’s business insurance policy.

      4. Barrk Training is covered by business insurance, but it is highly recommended that Customers have their own dog insurance to cover liability claims from a third party.

    8. Aggressive or Unsocial Animals

      1. Should any dog become aggressive or dangerous during the Services, Barrk Training shall, in their sole discretion, take whatever action they consider necessary in the best interest of the animal, other animals or people which may be encountered.

  2. Bookings & Cancellations

    1. General

      1. Bookings shall not be considered as ‘confirmed’ until Barrk Training provides the Customer with a Service Invoice and the Customer pays the fees as outlined.

      2. For Group Training Classes the Customer understands that the published fees pertain to the cost of a pre-defined course on a particular subject.

      3. Cancellations of Group Training Classes must be notified in writing to Barrk Training, no less than 7 (Seven) days before the session date, or no refund is due. If the Cancellation Policy period has passed, Barrk Training may offer the Customer another date to attend the missed class if another session is available. The Customer understands that this constitutes as a gesture of goodwill and that an alternative date may not be available.

      4. For Group Training Packages (Workshops) the Customer understands that the published fees pertain to the cost of a pre-defined course, consisting of multiple training sessions in one package. The course is sold as a package, and it is not possible to book or pay for individual sessions within these packages. Full payment for the package is required at the time of booking to secure the place for the agreed course time and date, which will be detailed on the Service Invoice.

      5. Cancellations of Group Training Packages (Workshops) must be notified in writing to Barrk Training. Should the Customer wish to cancel the entire package, no less than 14 (Fourteen) days notice is required from the start date, or no refund is due.

      6. Cancellations of individual classes within the Group Training Packages (Workshops) are not eligible for a refund. Barrk Training may offer the Customer another date to attend the missed class if another session is available. The Customer understands that this constitutes as a gesture of goodwill and that an alternative date may not be available.

      7. For One-to-One Training Sessions, the Customer understands that the focus for each session is based on the details given in the Customer Registration Form, and the Trainer’s observations during the dog’s Assessment Appointment.

      8. Cancellations of One-to-One Training Sessions must be notified in writing to Barrk Training, no less than 2 (Two) days before the session date, or no refund is due. If the Cancellation Period has passed, Barrk Training may offer the Customer alternative dates for the session. If the alternative dates offered declined or cancelled, the Customer shall receive no further alternative dates, and no refund shall be due.

      9. Barrk Training shall use all reasonable endeavours not to cancel or reschedule booked Services, however if cancellation or rescheduling is necessary at short notice due to Trainer illness or unsuitable weather, Customers will be given alternative dates to attend the session or a full refund.

    2. Fees & Payment

      1. Barrk Training will charge the Customer for the Services as quoted in the Service Invoice (the “Fees”) and the Customer agrees to pay Barrk Training the Fees in advance of any session.

      2. Should any payment due under this Agreement remain unpaid, Barrk Training will not have entered into any contractual obligations and shall offer the booked Services to other customers.

      3. Additional charges, including but not limited to statutory fees, congestion charges, bridge tolls, parking fees, excessive mileage, or fees related to non-standard working hours, may apply and will be specified on the service invoice.

      4. The Customer agrees to pay for any damage to company property or possessions arising from the behaviour of their dog whilst on Barrk Training premises, upon presentation of a valid receipt for replacement goods, or a quote for damage repair.

    3. Customer Obligations

      1. The Customer shall read and agree to follow the pertinent information in these Terms and Conditions, as is applicable for the required Services.

      2. The Customer shall use all reasonable endeavours to provide information to Barrk Training necessary for Barrk Training to provide Services.

      3. The Customer agrees that the information provided to Barrk Training is true to the best of their information, knowledge, and belief.

      4. The Customer may issue reasonable instructions to Barrk Training in relation to Barrk Training’ provision of Services. Any such instructions should be compatible with the specification of Services provided in the Terms and Conditions.

      5. The Customer authorises Barrk Training to carry out the Services.

    4. Force Majeure

      1. Neither party shall be liable in damages or have the right to terminate this Agreement for any delay or default in performing its obligations under this Agreement caused by conditions beyond its control including but not limited to acts of God, war, strikes, fires, floods, governmental restrictions, or power failures.

      2. The Party (the “Affected Party”) prevented from carrying out its obligations shall give notice to the other Party of an Event of Force Majeure upon it being foreseen by, or becoming known to, the Affected Party.

    5. Data Protection & Privacy

      1. Customers are advised that Barrk Training may take and use photographs or videos of dogs for marketing purposes; however, no specifics pertaining to the location of the dog, or the owner will be divulged publicly. If you do not wish Barrk Training to use photos of your dog for marketing purposes, please tell the company in writing via email.

  3. Group Training Classses & Packages

    1. Class & Session Attendance

      1. It is the Customer’s responsibility to ensure they attend on the correct date, time, and place for the classes according to the company’s instructions.

      2. Customers must tell Barrk Training in advance of attending group classes if their dog requires a muzzle. If Barrk Training agrees that the dog may attend a group class, the dog must wear a well-fitting muzzle for the session(s).

    2. Equipment & Behaviour

      1. Customers must ensure that dogs arrive wearing a well-fitted and secure flat collar with an ID tag. Extending and retractable leads are not permitted for training sessions.

      2. Dogs must be kept on a lead during training and away from other dogs unless agreed with the Trainer during the class.

      3. The Customer is responsible for bringing any recommended equipment advised by the company to the session.

      4. Customers are expected to clean up after their dogs in and around the training venue and must come to class suitably prepared with poop waste bags.

      5. Customers are required to keep their dog under control during the Services, and during wait periods before sessions begin. Barrk Training shall not be held liable for any accidents, incidents or injuries to Customers and their dogs outside the period of the class or session unless they can be proven to be negligent.

      6. Any dog that is unable to settle during a session causing disruption to the class may be removed from the class. Barrk Training may suggest an alternative class or solo training for the dog depending on the circumstances and the Trainer’s observations.

    3. Unneutered Dogs

      1. The Customer understands and agrees that females in season are not suitable to attend group sessions or classes. The Customer must contact Barrk Training and arrange to reschedule any booking for after the season is finished. This scenario falls outside of the cancellation policy.

      2. Female dogs that attend group classes whilst in season will be removed from the class.

  4. Subscriptions

    1. Overview

      1. Barrk Training offers subscription plans to provide customers with flexible access to training sessions and other benefits. By subscribing, you agree to the terms outlined below, in addition to the General Terms & Conditions.

    2. Tiers & Benefits

      1. Subscriptions are available in multiple tiers (e.g., Bronze, Silver, Gold, and Platinum), with each tier granting access to a defined number of group training sessions per month.

      2. Specific details about the number of sessions, pricing, and additional benefits for each tier are available on the Barrk Training website or by contacting us directly.

    3. Payments

      1. Subscription fees are charged monthly in advance. By signing up, you authorize Barrk Training to process recurring payments on your chosen payment method.

      2. All fees are non-refundable once the subscription period begins.

    4. Usage & Rollovers

      1. Unused sessions do not roll over to the next subscription month.

      2. Sessions must be booked and attended within the current subscription month.

    5. Upgrading or Downgrading

      1. You may request to upgrade or downgrade your subscription tier at any time. Changes will take effect at the start of the next billing cycle.

      2. Downgrades may result in a reduction in available sessions or benefits.

    6. Cancellation

      1. Subscriptions may be cancelled at any time by contacting Barrk Training

      2. Cancellation will be effective at the end of the current billing cycle, and no refunds will be issued for unused sessions or benefits.

    7. Suspension or Termination

      1. Barrk Training reserves the right to suspend or terminate subscriptions if a customer breaches the Terms and Conditions or displays behaviour detrimental to the safety or enjoyment of others.

      2. In such cases, no refunds will be issued for the remaining subscription period.

    8. Changes

      1. Barrk Training reserves the right to amend or discontinue subscription tiers and benefits. In such cases, customers will be given 30 days' notice, and any changes will take effect at the next billing cycle.

    9. Contact for Management

      1. For assistance with subscription management, including cancellations, upgrades, or downgrades, please contact Barrk Training via email or phone.

  5. Consultation Appointments

    1. Equipment

      1. Customers must ensure that dogs have a well-fitted and secure flat collar with an ID tag, and a lead. Extending and retractable leads are not advised.

      2. Dogs must be kept on a lead during the Assessment unless agreed with the Assessor during the visit.

      3. The Customer is responsible for providing any recommended equipment advised by the company to the Assessment.

      4. Customers must tell Barrk Training in advance of the Assessment if their dog requires a muzzle. The dog must wear a well-fitting muzzle for the Assessment.

    2. Feedback & Next Steps

      1. Any training plan provided shall be specific to the dog attending the Assessment Appointment. This plan is specifically designed for the intended recipient and should not be used for other dogs without prior consultation with Barrk Training. Its relevance or appropriateness for another dog cannot be guaranteed.

      2. Customers agree to take all necessary steps to aid the Assessor and to follow on with any instruction or advice provided by the Assessor. The Customer understand and accepts that if advice and training plans given by Barrk Training are not correctly followed, that their dog will not improve or transform as per any verbal or written assurances.

      3. If the training plan and next session require the presence of another dog to complete the lesson, providing the additional dog shall be added to the One-to-One session invoice.

  6. Private Training Sessions

    1. Equipment

      1. Customers must ensure that dogs have a well-fitted and secure flat collar with an ID tag, and a lead. Extending and retractable leads are not permitted for training sessions.

      2. Dogs must be kept on a lead during the Assessment unless agreed with the Assessor during the visit.

      3. The Customer is responsible for providing any recommended equipment advised by the company to the Assessment.

      4. Dogs that require a muzzle must wear a well-fitting muzzle for all Training Sessions.

    2. After Private Sessions

      1. Customers agree to take all necessary steps to follow on with any instruction or advice provided by the Trainer. The Customer understand and accepts that if advice and training plans given by Barrk Training are not correctly followed, that their dog will not improve as per any verbal or written assurances. Customers need to commit to reinforcing and practicing the training between sessions to see any improvement or transformation.

      2. If the training plan and next session require the presence of another dog to complete the lesson, providing the additional dog shall be added to the One-to-One session invoice.
